Terms and Conditions

1. Scope

These Terms and Conditions apply to purchases made through eu.japanese-melody.com and its EU-language versions (the “EU Store”).

These Terms apply primarily to consumers located in the European Union. A “consumer” is an individual acting for purposes outside their trade, business, craft, or profession.

Mandatory consumer rights under the law of the customer’s country of residence remain unaffected.

Japanese Melody Europe B.V. is the seller and contracting party for orders placed through the EU Store (https://eu.japanese-melody.com). Japanese Melody LLC is a separate affiliated United States company that operates the Japanese Melody business in the United States and is not the seller or payment recipient for EU Store orders.

2. Products and natural materials

Japanese Melody jewellery may contain natural or distinctive materials, including wood, minerals, meteorite, fossil material, shell, antler, leather, stone, or other organic and geological materials.

Natural variations in colour, grain, pattern, texture, markings, and appearance are expected. Product photographs are representative, but each piece may differ slightly. Such natural variations are not defects where the product otherwise conforms to its description and agreed characteristics.

Product dimensions, colours, and appearance may also vary slightly because of screen settings, lighting, hand-finishing, and normal manufacturing tolerances.

Where a product description refers to the source, classification, or authenticity of a material, we rely on supplier documentation, accepted trade descriptions, and reasonable verification procedures. Nothing in this section limits your statutory rights if a product is materially different from its description.

3. Eligibility to order

You must have legal capacity to enter into a purchase contract. A minor may place an order only with the permission and supervision of a parent or legal guardian.

You must provide accurate, complete, and current billing, delivery, and contact information.

4. Ordering and formation of the contract

Product displays on the EU Store are invitations to place an order and are not binding offers.

By completing checkout, you submit an offer to purchase the selected products. An automated order acknowledgement confirms receipt of your order but does not necessarily mean that the order has been accepted.

The purchase contract is formed when we send a dispatch confirmation or otherwise expressly confirm acceptance of the order.

We may refuse an order before acceptance where, for example:

  • the product is unavailable;

  • payment authorisation fails;

  • delivery to the stated address is unavailable;

  • the order appears fraudulent or abusive;

  • an obvious pricing or product-information error has occurred; or

  • accepting the order would breach applicable law.

If payment has already been taken for an order that we do not accept, we will refund it without undue delay.

5. Prices and VAT

Prices for EU consumers are displayed in euros and include applicable VAT, unless the checkout clearly states otherwise because of a legally permitted exception.

Delivery charges and any other unavoidable charges are shown before the order is submitted.

Where VAT rates differ by destination country, the final VAT-inclusive price may be adjusted at checkout according to the delivery country.

We may change prices for future orders at any time. A price change does not affect an order that has already been accepted.

6. Payment

Payments are processed through Shopify Payments and any additional payment method displayed at checkout.

Available methods may vary by delivery country, order value, device, and payment-provider eligibility. The customer must comply with the terms of the selected payment provider.

The order may be subject to payment authentication, fraud screening, and other security checks.

We do not store full payment-card details. Payment information is processed by the relevant authorised payment provider.

7. Delivery

We currently deliver only to addresses within the European Union.

Estimated delivery times are normally:

  • Standard delivery: 1–3 business days

  • Express delivery: 1–2 business days

These times are estimates and may be affected by weekends, public holidays, carrier disruption, remote-area delivery, incorrect address information, unusually high order volume, or circumstances outside our reasonable control.

Any longer production or preparation time for a made-to-order, personalised, limited-edition, or temporarily unavailable item will be stated on the relevant product page or communicated before acceptance.

Unless another delivery period has been agreed, we will deliver without undue delay and no later than the period required by mandatory consumer law.

Risk of loss or damage remains with us until the order is physically received by you or by a third party nominated by you, other than a carrier independently arranged by you.

8. Address accuracy and failed delivery

You are responsible for providing a complete and accurate delivery address.

Contact us promptly if you notice an address error. We cannot guarantee that an address can be changed after fulfilment has begun.

If delivery fails because of an incorrect or incomplete address, refusal of delivery, or failure to collect the parcel, we may deduct reasonable additional delivery or return-to-sender costs from any non-statutory refund, where legally permitted. This does not affect your mandatory rights.

9. Right of withdrawal and returns

Consumers generally have a statutory right to withdraw from an online purchase within 14 days after receiving the goods, without giving a reason.

10. Size exchanges

Eligible rings may be exchanged for another available standard size under the conditions in our Returns, Exchanges and Right of Withdrawal Policy.

Our voluntary size-exchange service is additional to, and does not replace, your statutory rights.

11. Personalised and custom-made products

The statutory right of withdrawal does not apply to products made to the customer’s individual specifications or clearly personalised, such as products with personalised engraving or expressly commissioned one-off specifications.

Selecting a standard ring size or another standard product option does not by itself make the product personalised.

Exclusion from the withdrawal right does not affect statutory rights relating to faulty, damaged, or non-conforming products.

12. Conformity and legal guarantee

We are responsible for delivering goods that conform to the contract.

If a product is faulty, damaged, or materially different from its description, you are entitled to the remedies provided by applicable consumer law. Depending on the circumstances, these may include repair, replacement, price reduction, or termination of the contract and refund.

EU consumers have a legal guarantee of at least two years from delivery. Some national laws, including rules based on the product’s reasonably expected lifespan, may provide longer protection.

Any commercial warranty offered by Japanese Melody is additional to, and does not restrict, these legal rights.

Normal wear, accidental damage, misuse, failure to follow care instructions, and expected natural variation are not automatically defects. This does not prevent you from demonstrating that a product was non-conforming at delivery.

13. Product care and safety

You are responsible for following the product-care and safety instructions provided with the product or on the EU Store.

Some people may experience sensitivity to metals, finishes, adhesives, leather, stone, or other materials. Stop wearing the product and seek appropriate advice if irritation occurs.

Jewellery and small components should be kept away from young children and pets.

14. Intellectual property

The EU Store and its content, including trademarks, product names, designs, photographs, video, text, graphics, certificates, logos, and other creative material, are owned by or licensed to Japanese Melody Europe B.V. or its affiliated rights holders.

You may access and use the EU Store for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, scrape, publish, sell, exploit, or create derivative works from the content without prior written permission, except where applicable law permits otherwise.

15. Reviews and customer content

If you submit a review, image, video, comment, or other content, you confirm that:

  • the content is based on your genuine experience;

  • it is accurate to the best of your knowledge;

  • you have the right to submit it; and

  • it does not infringe another person’s rights or contain unlawful, abusive, misleading, or harmful material.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, translate, format, and use that content for operating and promoting Japanese Melody, subject to applicable privacy and consumer law.

We may moderate or remove content where reasonably necessary, but we will not suppress a genuine negative review merely because it is unfavourable.

16. Website availability and errors

We take reasonable care to keep the EU Store accurate and available, but cannot guarantee uninterrupted or error-free operation.

We may correct typographical errors, technical errors, inaccurate availability information, or obvious pricing mistakes. Any correction affecting an accepted order will be handled in accordance with applicable law.

17. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • intentional misconduct or gross negligence;

  • mandatory product liability; or

  • breach of mandatory consumer rights.

To the maximum extent permitted by law, we are not liable for indirect or consequential business losses suffered by a consumer that were not reasonably foreseeable when the contract was formed.

These limitations do not affect the remedies available for faulty or non-conforming goods.

18. Force majeure

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, war, civil disturbance, governmental action, transport disruption, labour disputes, cyberattacks, major telecommunications failures, epidemics, or carrier interruption.

We will take reasonable steps to minimise the effect and will inform you where the delay materially affects your order. Mandatory rights relating to delayed delivery remain unaffected.

19. Complaints

Please send complaints to support@japanese-melody.com and include your order number, a clear description of the issue, and relevant photographs where appropriate.

We aim to acknowledge complaints within two business days and provide a substantive response within 14 calendar days. If more time is reasonably required, we will inform you.

20. Governing law and courts

These Terms and contracts made through the EU Store are governed by Dutch law.

If you are a consumer habitually resident in another EU Member State, this choice of law does not deprive you of mandatory protections available under the law of your country of residence.

A consumer may bring proceedings in any court that has jurisdiction under applicable EU and national law, including, where applicable, the courts of the consumer’s country of residence. We will bring proceedings against a consumer only in the courts permitted by mandatory law.

21. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be interpreted or replaced only to the minimum extent necessary and permitted by law.

22. Changes to these Terms

We may update these Terms for future use of the EU Store. The version applicable to an order is the version in effect when that order is placed, unless a change is required by mandatory law.
